I am after a bit of advice is anyone can help.
Basically at the moment my employer is refusing me time off to take my daughter to hospital for an operation due to another member of staff's holiday and has requested I make alternative arrangements - there are no other clinics available so nothing can be changed.
Can they legally do this?

I'd speak to your hr dept, and/or citizens advice.
I know that parents have certain rights related to care for their child up to the age of 5, in an emergency, either because the child is sick or the care giver is sick. How this extends to planned hospital admissions i have no idea. I would defi itely take it further though.

I found this (2nd part of answer) so yes I think he can refuse! Is it possible the other staff member could move one day forward or something for their holiday (obviously not if it involves flights but may be worth asking if you feel you can).

Thing is the office will have 4 other members of staff even when I am off

Hi, I don't think they can refuse you time off for a reasonable request such as your daughters surgery.
Have a look at the link below, there is a number for ACAS who can help further (they advised my sister when she had an issue at work and she managed to get resolution without needing to take it further just with the knowing the facts and employee rights).
